What is a public inquiry?
A public inquiry is a formal tribunal hearing where a Traffic Commissioner makes the final decision. There are three main types of public inquiry:
- To determine licence applications
- Reviews of operating centres for goods operator licences only
- Regulatory matters, where the future of transport operations is considered
When an application is heard, the Traffic Commissioner will assess evidence from the applicant, along with any valid objections. When reviewing an operating centre, they will consider evidence from the operator and any legitimate complainants. In regulatory cases, the Commissioner will review evidence from the operator, as well as material provided by the DVSA and other enforcement bodies.
Who are Traffic Commissioners?
Traffic Commissioners regulate the road transport industry in Great Britain. They are appointed by the Secretary of State for Transport but operate independently from Government and enforcement agencies such as the Driver and Vehicle Standards Agency.
Their role is to ensure that only safe and reliable operators of goods and passenger vehicles are granted licences.
Licences are issued based on the undertakings given by the applicant, and operators are expected to comply with these commitments throughout the life of the licence.
If an operator fails to meet these obligations, the Traffic Commissioner may take regulatory action, which can include revoking, suspending or curtailing the licence.
